DOES MICHIGAN FRIEND OF THE COURT DO AUTOMATIC CHILD SUPPORT REVIEWS?

There has been some discussion and confusion surrounding Friend of the Court in Michigan and when and how they will do a review of child support. For instance, this blog question by a Michigan resident:

“I thought the only way to have your child support reviewed was 1. Wait for the letter you get every 36 months asking if you want it reviewed or 2. Petition and pay to have it modified anytime, or 3. If you or the other person involved reports a change in income. I know the first 2 [sic] also involve a written form or letter that the petitioner must and the other party receives it along with the petition. Wouldn’t it be the same for the last. We are being told there is a new 2013 law requiring the Friend of the Court to do automatic reviews again. Our Lawyer does not know of any does anyone else?”

As always, to have your child support reviewed, you can make a motion in the court to which friend of the court will answer. Other than that, there is no automatic review process except the letter they send every two-plus years asking you if you would like to review child support.
