Under Michigan law, a regular DUI offense occurs when a driver over the age of 21 years old is operating a vehicle with a blood-alcohol level of 0.08% or higher, or if the driver is under the age of 21 years old and has a blood alcohol level of 0.02% or higher. A driver can also be charged with a regular DUI if operating a vehicle while intoxicated by any controlled substance. However, if the driver at any age has a blood alcohol level over 0.17%, then he or she can be charged with a super drunk DUI in Michigan.
